Terms of Service

You must be 18+ (or 21+ where legally required) to use CryptoKartz.
By creating an account, you confirm you meet the minimum age requirement for your jurisdiction.
§ 1 Platform Nature: Skill-Based, Not Chance
CryptoKartz is an XR (Extended Reality) skill-based gaming platform. Outcomes within the CryptoKartz environment are determined by player ability, decision-making, and in-game performance — not by random chance or house algorithms.
This distinction is significant in many jurisdictions where skill-based gaming is treated differently from games of chance or traditional gambling. Users are responsible for understanding how the platform is classified under the laws of their specific jurisdiction.
The platform provides wallet infrastructure and in-VR gaming functionality. CryptoKartz does not participate in, operate, or benefit financially from the outcome of any in-VR game played between users.
§ 2 Eligibility & Prohibited Jurisdictions
2.1 Age Requirement & Age Gate
You must be at least 18 years of age to create an account. In jurisdictions where online gambling, cryptocurrency gaming, or skill-based gaming is regulated, the minimum age may be 21 years. By creating an account, you confirm you are 18+ (or 21+ where required) and legally permitted to use this platform.
2.2 Meta Quest Requirement
CryptoKartz is designed for Meta Quest 3 or later headset owners. We reserve the right to verify device ownership via Meta/Facebook OAuth and to restrict access to users who do not own a qualifying device.
2.3 Prohibited Jurisdictions
The Service is not available to users in jurisdictions where the use of cryptocurrency or cryptocurrency gambling services is prohibited or requires licensing that CryptoKartz does not hold.
Prohibited jurisdictions include, but are not limited to:
- United States (certain states — see below)
- People's Republic of China
- Islamic Republic of Iran
- Democratic People's Republic of Korea (North Korea)
- Syrian Arab Republic
- Russian Federation (subject to applicable sanctions)
- Any jurisdiction where cryptocurrency gambling or blockchain gaming is expressly prohibited
United States users: Residents of Washington State, Nevada, New York, and New Jersey may be subject to additional restrictions under state law. Check your local laws before creating an account or using any platform feature.
VPN and jurisdiction spoofing: Users who use VPNs, proxy services, or other methods to conceal their location and access the Service from a prohibited jurisdiction are in material breach of these Terms. Such use may result in immediate account termination, forfeiture of funds, and referral to law enforcement.
You are solely responsible for determining the legality of your use of the Service in your jurisdiction before using the Service. CryptoKartz does not guarantee the legality of the Service in any jurisdiction.
§ 3 Account Responsibilities
You are solely responsible for:
- Maintaining the confidentiality of your account credentials (email, password, and all linked accounts)
- All activities that occur under your account
- Providing accurate and complete registration information
- Notifying us immediately of any unauthorized access at support@cryptokartz.live
- Backing up your 12-word BIP39 seed phrase securely offline
- Complying with all applicable laws in your jurisdiction regarding cryptocurrency, gaming, and taxation
You agree to indemnify and hold harmless CryptoKartz from any claims arising from your failure to protect your credentials or comply with applicable law.
§ 4 Non-Custodial Wallet & Seed Phrase
4.1 Non-Custodial Architecture
CryptoKartz generates and stores your wallet credentials in a non-custodial architecture. This means:
- We do not hold, control, or have access to your private keys or seed phrase after initial generation
- You retain full ownership and control of your cryptocurrency funds
- All transactions are signed in your browser or the CryptoKartz application on Meta Quest and broadcast directly to the relevant blockchain
- Private keys are never transmitted to CryptoKartz servers after wallet generation
What we store server-side (encrypted): Your 12-word BIP39 seed phrase is encrypted using AES-256-GCM and stored on our servers as a backup recovery mechanism. This encrypted backup may be used to restore your wallet if you are locked out of your account.
What we never store or expose: Your private keys are generated locally and are never transmitted to, stored on, or accessible by CryptoKartz personnel at any time.
4.2 Seed Phrase — Shown Once. Your Responsibility.
CRITICAL: Your 12-word BIP39 seed phrase is shown to you exactly once at the time of wallet creation. CryptoKartz cannot recover your seed phrase for any reason. If you lose access to your seed phrase, you will lose access to your cryptocurrency funds permanently.
You must:
- Write down your seed phrase and store it securely offline — in a safe, a bank deposit box, or another secure location
- Never share your seed phrase with anyone — including CryptoKartz staff, support agents, or anyone claiming to be from the platform
- Never enter your seed phrase into any website or application other than the official CryptoKartz portal
- Be aware that anyone who has your seed phrase has complete, permanent, and irreversible control of all funds in your wallet
CryptoKartz will never ask you for your seed phrase. If you receive a request for your seed phrase from anyone claiming to represent CryptoKartz, it is a scam. Report it to support@cryptokartz.live immediately.
4.3 Transaction Finality
All blockchain transactions are irreversible once confirmed on-chain. CryptoKartz is not responsible for transactions sent to incorrect addresses, the wrong blockchain, or as a result of scams or phishing attacks. Always verify destination addresses and the target blockchain network before confirming any transaction.
§ 5 Cryptocurrency Risk Disclosures
Cryptocurrency ownership, storage, and transactions involve significant financial risk. By using CryptoKartz, you acknowledge and accept the following:
- Extreme volatility: Cryptocurrency values can fluctuate dramatically within minutes or hours. The market value of any cryptocurrency in your wallet may increase or decrease significantly. You may lose all or substantially all of the value of your holdings.
- No FDIC or deposit insurance: Cryptocurrency assets are not insured by the Federal Deposit Insurance Corporation (FDIC), the Securities Investor Protection Corporation (SIPC), or any equivalent governmental insurance scheme in any jurisdiction. In the event of platform failure, your assets may be lost.
- Not securities or investment contracts: CryptoKartz wallet services, cross-chain swap functionality, and the CryptoKartz portal do not constitute the offer or sale of securities, investment contracts, or investment advisory services. Nothing in this Service constitutes financial or investment advice.
- No guarantee of asset value: CryptoKartz makes no promises, guarantees, or warranties about the future value of any cryptocurrency. Past performance is not indicative of future results.
- Irreversibility of blockchain transactions: There is no chargeback, refund, reversal, or dispute mechanism for confirmed blockchain transactions. Once a transaction is confirmed on-chain, it is permanent and cannot be undone by CryptoKartz, any government, or any other party.
- Regulatory uncertainty: Cryptocurrency regulation is evolving. New laws, regulations, enforcement actions, or bans may restrict or eliminate your ability to use certain cryptocurrencies or the Service in your jurisdiction. You are solely responsible for monitoring applicable laws.
- Network and infrastructure risks: Blockchain networks may experience congestion, forks, upgrades, halvings, or other events that affect transaction speed, fees, and confirmations. Solana, Bitcoin, and Ethereum networks operate independently of CryptoKartz and may be subject to outages or upgrades without notice.
§ 6 No Financial, Investment, Tax, or Legal Advice
CryptoKartz does not provide financial, investment, legal, or tax advice of any kind. This includes, without limitation:
- Advice about whether to buy, sell, hold, transfer, or stake any cryptocurrency
- Recommendations on cryptocurrency allocation, diversification, or portfolio construction
- Tax advice regarding the classification or reporting of cryptocurrency transactions
- Regulatory guidance on the classification of any token, digital asset, or platform feature
- Assessment of the suitability of the Service for any user's specific financial situation
All decisions about cryptocurrency transactions, gaming outcomes, and fund management are solely your own. You should consult a qualified financial advisor, attorney, and/or tax professional before making any financial decisions involving cryptocurrency.
§ 7 Cross-Chain Swaps (Jupiter & Bridge Infrastructure)
Swap functionality is provided through the Jupiter Aggregator v6 protocol. CryptoKartz acts as an interface to Jupiter. Swaps involve Solana, Bitcoin, and Ethereum and may route across multiple blockchain networks.
7.1 Slippage Risk
Swap quotes are valid only at the moment of execution. Cryptocurrency market prices can move between quote generation and transaction confirmation. If the market moves beyond your configured slippage tolerance:
- The swap may execute at a worse rate than quoted
- A portion of the swap may be executed while the remainder is refunded
- The swap may fail entirely
You are responsible for setting an appropriate slippage tolerance. We recommend not exceeding 1% for stable token pairs and 3-5% for volatile pairs, though market conditions may require higher settings.
7.2 Bridge Risk
Cross-chain swaps between Solana, Bitcoin, and Ethereum rely on bridge infrastructure (including Wormhole and similar protocols). Bridge transactions are subject to additional confirmation requirements and security assumptions not present in native token transfers.
Bridge-specific risks include:
- Bridge smart contracts may have vulnerabilities that could result in partial or total loss of bridged assets
- Bridges may be paused, restricted, or exploited without notice
- Confirmation times for bridge transactions may be significantly longer than native blockchain transfers
- In extreme cases, bridge transactions may fail or result in a "stuck" state requiring manual recovery
7.3 Smart Contract Risk
Tokens on Ethereum (including bridged assets) are governed by smart contracts. Bugs, upgrade vulnerabilities, reentrancy attacks, or exploits in token contracts or decentralized exchange protocols used in the swap path may result in partial or total loss of funds.
7.4 Partial & Failed Swaps
A swap may execute partially if the output token amount falls below the minimum threshold or your configured slippage tolerance is exceeded. In such cases, you will receive a proportional amount of the output token based on available liquidity at execution time.
A swap may fail entirely if:
- Insufficient liquidity is available for the requested amount
- Network transaction fees are inadequate
- The Jupiter protocol is paused or experiencing high error rates
- The relevant blockchain network is congested or experiencing an outage
- The destination blockchain RPC is unavailable
Failed transactions may still incur network transaction fees. CryptoKartz is not responsible for fees incurred on failed or partially completed swap attempts.
7.5 Jupiter Aggregator — Third-Party Protocol
CryptoKartz provides an interface to the Jupiter Aggregator v6 protocol. Jupiter independently determines swap routing, pricing, and execution. We do not control Jupiter's smart contracts, pricing algorithms, or liquidity sources. Jupiter's Terms of Service apply and are available at jup.ag.
§ 8 Acceptable Use
You agree NOT to use CryptoKartz to:
- Engage in any activity that is illegal under applicable law in your jurisdiction
- Money launder, finance terrorism, fund prohibited organizations, or facilitate sanctions evasion
- Attempt to access wallets, accounts, or data you do not own or have explicit authorization to access
- Interfere with the operation of the Service or blockchain infrastructure supporting the platform
- Use automated bots, scripts, or cheat programs in the XR gaming environment
- Collude with other users to manipulate gaming outcomes
- Create multiple accounts (multi-accounting) to circumvent limits, self-exclusions, or responsible gambling controls
- Impersonate CryptoKartz staff, affiliates, or partners
- Introduce malware, viruses, exploits, or malicious code into the Service
- Use VPNs, proxy services, or other tools to circumvent jurisdiction restrictions (see Section 2.3)
- Use chargebacks, payment disputes, or fraudulent payment methods in connection with the Service
Violations may result in immediate account suspension, forfeiture of funds, and referral to law enforcement authorities.
§ 9 Account Suspension & Termination
CryptoKartz reserves the right to suspend, limit, or permanently terminate accounts for any of the following reasons:
- Fraud or cheating: Use of bots, exploits, multi-accounting, collusion, or any activity that constitutes unfair play in the XR gaming environment
- Underage use: Account belonging to a user who is or was underage at the time of registration
- Jurisdiction violations: Use of VPN, proxy, or other tools to access the Service from a prohibited jurisdiction (Section 2.3)
- Chargebacks and payment fraud: Disputed payments, fraudulent credit card use, or payment reversal in connection with any platform purchase
- Breach of these Terms: Any material violation of the Acceptable Use policy (Section 8) or other provisions of these Terms
- Investigation: Accounts under active investigation for suspected illegal activity, money laundering, or terrorism financing
- Self-exclusion: Accounts that have elected self-exclusion (Section 13) may not be reactivated before the self-exclusion period ends
- Service discontinuation: CryptoKartz may discontinue the Service at any time with reasonable notice
Where permitted by law, CryptoKartz may freeze or forfeit funds in accounts that have been terminated for cause. You may delete your account and request data deletion at any time by contacting support@cryptokartz.live. Data deletion is subject to legal retention requirements and does not affect the immutable nature of blockchain transaction records.
§ 10 Third-Party Services
The Service integrates with third-party blockchain infrastructure and protocols:
- Solana mainnet RPC — Solana Labs; Solana blockchain operates independently under its own governance
- Blockstream.info — Bitcoin RPC and API services
- Ethereum RPC (via Cloudflare) — Ethereum mainnet access for ETH and ERC-20 tokens
- Jupiter Aggregator v6 — Decentralized swap aggregation protocol
- Meta Platforms (Facebook OAuth) — Device verification and account linking
- Late.dev / Late Labs — Social media OAuth integrations (Twitter/X, Instagram, TikTok, LinkedIn)
- Cloudflare — DDoS protection and content delivery
These services operate under their own terms, privacy policies, and governance structures. CryptoKartz is not responsible for the availability, accuracy, security, or conduct of any third-party service, including any blockchain network.
§ 11 Limitation of Liability
To the maximum extent permitted by applicable law, CryptoKartz and its affiliates, officers, directors, employees, and agents are not liable for:
- Loss of cryptocurrency funds due to user error, forgotten seed phrases, forgotten passwords, scams, or phishing
- Losses arising from blockchain network failures, congestion, chain forks, network upgrades, consensus changes, or validator outages
- Service downtime, delays, errors, or discontinuation — scheduled or unscheduled
- Losses resulting from reliance on Jupiter swap services, bridge protocols, or any third-party blockchain service
- Any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data
- Physical injury, equipment damage, or hardware failure arising from use of the Meta Quest headset or any XR hardware
- Psychological distress, financial harm, or gambling-related harm arising from use of the gaming platform
- Errors or omissions in blockchain address validation — always verify addresses manually before transacting
- Any failure of Meta Quest hardware, software, or firmware to operate with the CryptoKartz application
Total aggregate liability of CryptoKartz under these Terms shall not exceed USD $100 or the equivalent in cryptocurrency at the time of the claim, whichever is less.
§ 12 Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Service will be uninterrupted, error-free, or always available
- The Service will be secure or free of vulnerabilities, bugs, or exploits
- Gaming outcomes will be fair, accurate, or free from technical error
- Third-party services (Jupiter, RPC providers, bridges) will be available or accurate
- The Service will be free of viruses or other harmful components
You assume full responsibility for the risks associated with using cryptocurrency services, XR hardware, and blockchain infrastructure.
§ 13 Responsible Gambling
Cryptocurrency gaming in an XR environment carries real financial and psychological risks. CryptoKartz is committed to responsible gambling principles and provides the following tools and resources.
13.1 Self-Exclusion
You may self-exclude from the platform at any time by contacting support@cryptokartz.live. Self-exclusion periods available:
- 24-hour cooling-off period
- 7-day self-exclusion
- 30-day self-exclusion
- Permanent self-exclusion (indefinite)
During any self-exclusion period, your account will be locked and you will not be able to access the platform or conduct any cryptocurrency transactions. Self-exclusion cannot be reversed before the chosen period expires (except for 24-hour cooling-off periods).
13.2 Deposit & Transaction Limits
You may request deposit limits or transaction frequency limits by contacting support@cryptokartz.live. Limits may be set, reduced, or removed by request. Increases to existing limits take effect after a 72-hour cooling-off period.
13.3 Support Resources

13.4 Reality Check & Play Awareness
VR gaming can cause disorientation and loss of spatial awareness. CryptoKartz recommends:
- Taking regular breaks (at least 10-15 minutes every hour)
- Playing in safe, open spaces clear of obstacles
- Never playing while under the influence of alcohol, prescription medication affecting coordination, or in a fatigued state
- Supervision by a responsible adult if playing for extended periods
13.5 Family Controls
Parents and guardians of minors should use Meta's built-in parental controls (supervision features) to restrict Meta Quest device usage. CryptoKartz does not have the ability to override device-level parental controls set by the account holder or their guardian.
§ 14 Anti-Money Laundering (AML) & Know Your Customer (KYC)
CryptoKartz is committed to preventing the use of its platform for money laundering, terrorism financing, or other financial crimes.
The platform reserves the right to:
- Implement Know Your Customer (KYC) procedures at any time, including identity verification, address verification, and source-of-funds inquiries
- Request additional documentation from users at any time to verify account ownership or the legitimacy of transactions
- Block, freeze, or flag transactions that appear suspicious or inconsistent with normal account activity
- Report suspicious activity to the relevant financial crimes units, financial intelligence units, or law enforcement agencies as required by applicable law
- Terminate accounts that fail KYC verification or are associated with suspicious activity
Users must provide accurate, up-to-date information during any KYC or AML verification process. False or misleading information may result in immediate account termination and referral to law enforcement.
§ 15 Indemnification
You agree to defend, indemnify, and hold harmless CryptoKartz and its affiliates, officers, directors, employees, agents, successors, and assigns from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of, or inability to use, the Service
- Your violation of these Terms or any applicable law
- Your violation of any third party's rights, including any intellectual property, privacy, or data protection right
- Your use of VPN, proxy, or other tools to circumvent jurisdiction restrictions
- Any dispute or claim arising from cryptocurrency transactions you initiate, including sent-to-wrong-address scenarios
- Any fraud, cheating, or Terms violation committed by you or someone using your account
§ 16 Dispute Resolution & Binding Arbitration
You and CryptoKartz agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or your use of the platform — including disputes about the enforceability of this arbitration clause — will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Arbitration is binding and final. By accepting these Terms, you waive your right to pursue claims in court before a judge or jury. You also waive your right to participate in a class action lawsuit or class-wide arbitration.
Exceptions: The following disputes are not subject to mandatory arbitration and may be filed in court:
- Claims that fall within the jurisdiction of a small claims court (if applicable)
- Claims for injunctive or equitable relief related to intellectual property (Section 19) or unauthorized use of the platform
Opt-Out: You may opt out of this binding arbitration requirement within 30 days of first accepting these Terms by sending a written opt-out request to legal@cryptokartz.live with the subject line "Arbitration Opt-Out." Your opt-out request must include your full name, email address, and account details.
Governing Rules: Arbitration will be conducted by a single arbitrator in San Francisco, California, unless the parties agree otherwise. The arbitrator's decision will be final and binding, and the judgment on the arbitration award may be entered in any court of competent jurisdiction.
Costs: Each party will bear its own costs of arbitration. CryptoKartz will cover filing fees and the arbitrator's fees for claims up to $10,000 unless the arbitrator determines the claim is frivolous.
§ 17 Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any dispute that does not require arbitration (or where arbitration is waived per Section 16) shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
You agree to waive any objections to the exercise of jurisdiction by such courts and to accept service of process by mail and email. If you are accessing the Service from outside the United States, you do so voluntarily and are responsible for compliance with local law.
§ 18 Amendments to These Terms
We may modify these Terms at any time. Material changes will be communicated via email to the address associated with your account and/or a prominent notice on the platform. Changes will include an updated "Last updated" date.
Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account by contacting support@cryptokartz.live.
§ 19 Intellectual Property
The CryptoKartz name, logo, branding, visual design, VR assets, software, source code, and all content published on the CryptoKartz portal (cryptokartz.live and cryptokartz.live) are the intellectual property of CryptoKartz or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes only. You may not:
- Reproduce, distribute, or create derivative works from CryptoKartz intellectual property without written authorization
- Use CryptoKartz branding, logos, or visual design in any marketing, derivative, or third-party product without permission
- Reverse engineer, decompile, or disassemble the CryptoKartz software or VR application
- Register domain names, trademarks, or social media handles that include "CryptoKartz" or confusingly similar names
All rights not expressly granted in these Terms are reserved by CryptoKartz.
